1. Acceptance of Terms
By accessing or using the Community PACT platform (the "Platform"), creating an account, or submitting any content, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms apply to all visitors, registered users, and stakeholders.
2. License to User-Submitted Content
By submitting any content to Community PACT — including but not limited to commitment records, comments, votes, evidence links, documents, official updates, or other materials ("User Content") — you grant Community PACT LLC a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable license to use, reproduce, modify, publish, distribute, publicly display, and create derivative works from that User Content in connection with operating, improving, and promoting the Platform. This license survives account termination.
3. User Representations & Warranties
By submitting User Content, you represent and warrant that:
- You own or have all necessary rights, licenses, consents, and permissions to submit the User Content and to grant the license described in Section 2;
- Your User Content does not infringe any third-party intellectual property, privacy, publicity, or other rights;
- Any external links or resources you post are ones you are permitted to share and do not violate applicable laws or third-party rights;
- Your User Content is accurate and truthful to the best of your knowledge;
- Your use of the Platform complies with all applicable federal, state, and local laws and regulations.
4. Accuracy of Content & Prohibition on False Claims
Community PACT is a civic accountability platform. The accuracy and integrity of information posted here is critical to its mission. You agree that you will not post, submit, or otherwise contribute content that is:
- False, fabricated, or materially misleading;
- Defamatory, libelous, or otherwise harmful to the reputation of any individual, organization, or public official;
- Based on information you know to be inaccurate or that you have no reasonable basis to believe is true.
Users who post false, defamatory, or misleading content bear sole legal responsibility for such content. Community PACT LLC expressly disclaims any liability for damages arising from inaccurate or false User Content. Violations of this section may result in content removal, account suspension, or permanent termination at our sole discretion.
5. Platform Disclaimer for User-Generated Content
Community PACT LLC is an interactive computer service as defined under 47 U.S.C. § 230 (the Communications Decency Act). We are not the publisher or speaker of User Content submitted by third parties. We expressly disclaim all liability arising from User Content posted by our users, including but not limited to:
- The accuracy, completeness, or truthfulness of any commitment record, comment, or evidence submitted by users;
- Any claims, demands, or damages arising from User Content posted on the Platform;
- The content or accuracy of any external links or third-party resources submitted by users.
We do not endorse any User Content or the opinions expressed therein. Commitment statuses, accountability scores, and other data on this Platform are derived from user-submitted information and should not be relied upon as official or verified without independent confirmation.
6. Content Dispute & Takedown Process
If you are a stakeholder, public official, organization, or other affected party and believe that content on the Platform is false, inaccurate, or otherwise should be reviewed, you may submit a written dispute request to:
info@communitypact.org — Subject: "Content Dispute Request"
Your dispute request must include:
- Identification of the specific content at issue (URL, commitment title, or comment identifier);
- The basis for the dispute — specifically, why the content is false, misleading, or otherwise improper;
- Any supporting documentation or evidence you wish us to consider;
- Your full name, title, and contact information.
Upon receipt of a properly submitted dispute, Community PACT LLC will review the request within 30 days and may, at our sole discretion:
- Mark the content as "Disputed" using the Platform's built-in dispute status;
- Hide the content pending review;
- Remove the content if we determine it violates these Terms;
- Take no action if we determine the content is accurate or permissible.
Submission of a dispute does not guarantee removal of content. We are not required to act on every dispute request. Frivolous, bad-faith, or repeated unfounded dispute submissions may result in action against the submitter's account.
7. DMCA Safe Harbor & Copyright Policy
Community PACT LLC complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe that content on the Platform infringes your copyright, please send a written notice to info@communitypact.org — Subject: "DMCA Notice" — containing all of the following:
- Identification of the copyrighted work you claim has been infringed;
- Identification of the infringing material and its location on the Platform (URL or description);
- Your name, address, telephone number, and email address;
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or law;
- A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf;
- Your physical or electronic signature.
We will promptly investigate valid DMCA notices and remove or disable access to infringing content as required by law. Repeat infringers may have their accounts terminated.
8. Indemnification
You agree to indemnify, defend, and hold harmless Community PACT LLC and its officers, directors, employees, contractors, agents, licensors, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of any third party. This indemnification obligation survives termination of your account and these Terms.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
COMMUNITY PACT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE PLATFORM; (B) ANY USER CONTENT ON THE PLATFORM, INCLUDING FALSE OR INACCURATE COMMITMENTS OR RECORDS; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; OR (D) ANY OTHER MATTER RELATED TO THE PLATFORM. OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER OR RELATING TO THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
10. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York. You consent to personal jurisdiction in such courts and waive any objection to venue.
11. Modifications to Terms
Community PACT LLC reserves the right to modify these Terms at any time. We will post the updated Terms on this page with a revised effective date. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Platform and may delete your account.
